Authentic Seacoast Photo Contest
OFFICIAL CONTEST ENTRY RULES
NO PURCHASE NECESSARY. The Authentic Seacoast Photo Contest is open to legal residents Canada, excluding Quebec. The deadline for entering the contest is Thursday, June 26, 2008 12:00 Noon ADT.
HOW TO ENTER: Visit the Authentic Seacoast Photo section of www.authenticseacoast.com before 12:00 NOON AST, Thursday, June 26, 2008. Each entrant will be required to upload an original photo showing an Authentic Seacoast vacation experience and complete the Official Registration Form by following the instructions provided on the website. No other methods of entry will be accepted. Limit one (1) entry per person per day. Entries are limited to individuals only; commercial enterprises and business entities are not eligible. The Authentic Seacoast Properties, (herein known as the “Sponsor”), are not responsible for incorrect or inaccurate entry of information by participants; lost entries or transmissions, interrupted or unavailable network, server, or other connections; scrambled transmissions or other errors or problems of any kind whether mechanical, human, or electronic, technical malfunctions or the computer hardware, software, or any combination thereof; or problems associated with any virus or any other damage caused to participants' systems. Incomplete entries will be voided. All entries and submitted content become the property of the Sponsor will not be returned, and may be used in advertising and publicity without compensation. By entering, Entrant agrees that if he or she is randomly selected as the winner of the vacation package prize (see Prizes), Entrant grants the Sponsor and/or its affiliates, agents, and licensees permission to film and/or photograph Entrant and/or guests during use of Prize, at a time and place to be mutually agreed upon by Entrant and the Sponsor, and grants the Sponsor the unconditional and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used) such film, video, and/or photograph without compensation and limitation (see Conditions of Entry). Winner will be randomly selected among complete entries on or after June 26, 2008.
CONDITIONS OF ENTRY: As conditions of entry into this Contest, and by uploading and entering a Submission, Entrant warrants and represents that the Submission (a) is original and has been legally created by the Entrant, (b) does not infringe the intellectual property, privacy or publicity rights or any other legal or moral rights of any third party; (and (c) has not been published or distributed previously in any media. Entrant represents that he/she owns all rights to his/her Submission, including, without limitation, the copyrights in the recording and the performance contained therein. Entrant further represents and warrants that the Entrant has obtained permission from each person whose name, image, likeness or voice ("Likeness") is included in the Submission, and that such person(s) have granted Entrant all necessary rights to use the person's Likeness as described in these rules, and that Entrant can make written copies of such permissions available to the Sponsor upon request. If the Likeness of a minor is included, such grant of rights must include written permission from the minor's parent or legal guardian authorizing the use of the minor's likeness on behalf of the minor. By uploading a Submission, Entrant irrevocably grants the Sponsor and its affiliates, legal representatives, assigns, agents and licensees, the unconditional and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used), the Entrant's Submission, including, but not limited to, the recording and the performances contained therein (in each case, as submitted or as edited/modified in any way by the Sponsor, in its sole discretion), as well as to use Entrant's name, likeness, photograph, video (collectively, "Likeness"), and/or statements regarding his/her participation in this Contest (with or without using the Entrant's name) in any and all media without limitation as to time or territory, and without additional compensation or approval from the Entrant or any other party. Entrant waives intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude the Sponsor's use of the submission, and agrees not to sue or assert any claim against the Sponsor for the use of the Submission or Entrant's Likeness or statements. Entrant agrees to indemnify and hold the Sponsor, its agencies and their respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the "Indemnities"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Indemnities due to or arising out of the Entrant's Submission, or the Entrant's conduct in creating a Submission or otherwise in connection with this contest, including but not limited to claims for trademark infringement, copyright infringement; violation of an individuals right of publicity or right of privacy; or defamation. Entrant further agrees to release the Sponsor from any and all claims that any advertising subsequently produced, presented, and/or prepared by or on behalf of the Sponsor infringes Entrant's rights with regard to any elements, characters or ideas contained in any submission. Entrant agrees that if he or she is randomly selected as the Winner of the getaway package prize (see Prizes), Entrant irrevocably grants the Sponsor and/or its affiliates, agents, and licensees permission to film and/or photograph Winner and/or his or her guests during use of Prize, at a time and place to be mutually agreed upon by Winner and Sponsor, and gives the Sponsor the unconditional and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times used) such film, video, and/or photograph (collectively, "Likeness"), without compensation and limitation; including, but not limited to, the recording and the performances contained therein (in each case, as recorded/photographed or as edited/modified in any way by the Sponsor, in its sole discretion), as well as to use Winner's and/or guests' name, likeness, photograph, video and/or statements regarding his/her participation in this Contest (with or without using the Entrant's name) in any and all media without limitation as to time or territory, and without additional compensation or approval from the Winner, his or her guests, or any other party. Winner and his or her guests waive intellectual property rights, privacy/publicity rights or other legal or moral rights that might preclude Sponsor use of the film/video/photograph, and agrees not to sue or assert any claim against the Sponsor for the use of the Winner's and guests' Likeness or statements. Winner agrees to indemnify and hold the Sponsor, its agencies and their respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the "Indemnities"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Indemnities due to or arising out of the Sponsor's use of Winner's and guests' Likeness, or the Winner's and guests' conduct in connection with this Contest, including but not limited to claims for trademark infringement, copyright infringement; violation of an individuals right of publicity or right of privacy; or defamation. Winner and guests further agree to release Sponsor from any and all claims that any advertising subsequently produced, presented, and/or prepared by or on behalf of the Sponsor infringes Winner's and his or her guests' rights with regard to any elements, characters or ideas contained in any use of Winner's and his or her guests' Likeness.
ELIGIBILITY: Open to all legal residents of Canada, except employees of the Authentic Seacoast Properties and their immediate family members and those living in the same household are not eligible to enter. Limit one (1) entry per person per day. All applicable federal, provincial and local laws apply. No entry fee, payment, or proof of purchase necessary to enter the Contest. Void where restricted or otherwise prohibited by law.
PRIZES: One winner will receive an Authentic Seacoast Getaway Package to Osprey Shores Golf Resort that includes two (2) nights' accommodations for two (2) people (double-occupancy), one (1) $75 food voucher to be used at any Authentic Seacoast Property, continental breakfast daily for two (2), and two (2) rounds of golf at the Osprey Shores Golf Course. Approximate Retail Value: $439.00
PLEASE NOTE: Travel must be completed by April 30, 2009. Blackout dates and other restrictions may apply and reservations are based on space availability. Winner and his/her guests will be solely responsible for all other expenses not specifically set forth herein including but not limited to taxes, meals, gratuities, souvenirs, transportation, and any other incidentals, fees, service charges, etc.
GENERAL RULES & CONDITIONS: By participating in the Contest, entrants agree to be bound by these Official Rules. Winner will be notified by phone, e-mail, and/or regular mail and will be required to sign and complete an Affidavit of Eligibility/Release, where legally permissible, and liability and return it within five (5) days of receipt of attempted delivery to receive the specified prize, otherwise the specified prize may be forfeited and awarded to an alternate winner. The winner's travel companion will be required to sign and return an Affidavit of Eligibility/Release (where legal) prior to issuance of package. If the travel companion is a minor, the minor must have parent/legal guardian sign documents on his/her behalf and must be accompanied by a parent or legal guardian on trip. Prize winner gives the Sponsor the right to use prize winner's photo entry, name, voice, picture, and likeness in advertising and publicity without further compensation, where permitted by law. By accepting the prize, prize winner agrees to release the Sponsor and its employees, advertising and promotion agencies, prize providers and other coordinating agencies involved in the promotion from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the promotion or for damages of any kind caused by any prize or resulting from acceptance, possession, or use/misuse of prize awarded, or while preparing for, participating in, and/or traveling to and from any prize-related activity. All local, provincial and federal taxes are the sole responsibility of winner. No substitution or transfer of prize or election of cash in lieu of prize will be permitted. If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of the Sponsor which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsor reserves the right, at its sole discretion, with appropriate legal approval, to cancel, terminate, modify, or suspend the Contest and to select the single prize winner from among the entries received prior to the suspension or termination of the program; and the Sponsor further reserves the right to disqualify any individual who tampers with or in any way corrupts the entry process. Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages from any such entrant or any other individual to the fullest extent permitted by law.
